Article 151
De l'interrogatoire des prévenus
Titre II:
De la procédure criminelle
(On Criminal Procedure)
Chapitre IV:
De l'interrogatoire des prévenus
(On the Interrogation of the Accused)
Si le crime entraîne une peine capitale, il ne lui accordera cette permission qu'après la confrontation ; il le préviendra de se choisir un conseil ; et si l'accusé n'en fait choix, il lui en nommera un d'office.
Life lesson:
In capital cases, the accused can't consult anyone until after the confrontation with witnesses — but the judge must then advise them to get a lawyer, and appoints one if they don't.
Notes:
Capital crime counsel provisions: consultation delayed until after confrontation. Judge must advise accused to choose conseil. Mandatory appointment d'office if accused doesn't choose. Early appointed counsel provision for capital cases. Most restrictive regime: no consultation until post-confrontation. Embryonic right to legal representation.
