The new council met on Saturday 18 November, at eight o’clock in the morning, at the fort of Croix-des-Bouquets, where the trial began. The military prosecutor was the artillery lieutenant Guignard. J.-P. Mercure and Dorval, his son, had as counsel maîtres Joseph Lespinasse and Mullery, and maîtres Dumai Lespinasse and Daphnet pleaded for Milfort Montalet and Joseph Mathurin. The proceedings lasted from 18 November until midnight on the 24th. J.-P. Mercure, Dorval and Milfort Montalet were again found guilty of complicity and condemned to death; Joseph Mathurin, found guilty of misprision, was condemned to imprisonment. They appealed for review. On 8 December the council of review of Port-Républicain, presided over by general Louis Rigaud, upheld the judgment.
