Des décrets ou mandats

Criminal Procedure
Titre II: De la procédure criminelle (On Criminal Procedure)
Chapitre V: Des décrets ou mandats (On Decrees or Warrants)

Hors le cas de flagrant délit, ainsi que le prescrit l'article 118, tout mandat ne pourra être décerné par le juge d'instruction, que sur les conclusions du procureur du roi, auquel l'information aura été préalablement communiquée.

Life lesson: Outside flagrant crimes, the investigating judge can't issue any warrant without first sharing the case file with the prosecutor and getting his formal recommendation.
Notes: Prosecutorial gatekeeping for warrants: mandatory conclusions du procureur du roi before any mandat. Préalable communication of information required. Exception: flagrant délit per Art. 118. Checks on judicial arrest power. Dual-authority model for deprivation of liberty.
