Le jugement qui intervient sur la récusation est exécutoire, nonobstant l'appel; si elle est admise, il est nommé un nouvel expert par le même jugement; mais si la récusation est rejetée, la partie qui l'aura faite est condamnée aux dommages et intérêts, même envers l'expert s'il le requiert; en ce cas, il en sera nommé un autre.

Life lesson: Win the challenge and the court replaces the expert immediately. Lose and you pay damages — even to the expert personally if they demand it.
Notes: Récusation outcomes: admitted → new expert appointed (same judgment), exécutoire nonobstant appel. Rejected → challenger pays dommages-intérêts (including to expert on request). Replacement expert named regardless. Strong deterrent against frivolous challenges.
