De la Compétence des Cours d'Amirauté

Commercial Law
Titre V: Des Testamens, Inventaires, et Compétence des Cours d'Amirauté (On Wills, Inventories, and Admiralty Court Jurisdiction)
Chapitre II: De la Compétence des Cours d'Amirauté (On the Jurisdiction of the Admiralty Courts)

Les cours d'appel, dans aucun cas, pas même pour raison d'incompétence, ne pourront suspendre l'exécution des jugemens de la cour d'amirauté; mais ces cours évoqueront la cause qui sera plaidée devant elles.

Life lesson: Appeal courts cannot halt admiralty enforcement — not even by claiming the admiralty was incompetent. They must hear the case themselves.
Notes: Non-suspensive appeal: appellate courts CANNOT suspend admiralty judgment execution, not even for incompétence. Must evoke (take up) the case instead. Admiralty judgments always enforceable pending appeal. Strong execution priority.
