L'action en rescision a lieu en faveur du mineur non émancipé, pour simple lésion contre toutes sortes de conventions, et en faveur du mineur émancipé, contre les conventions qui excèdent les bornes de sa capacité, telle qu'elle est déterminée au Titre des Tutelles.

Life lesson: Unemancipated minors can undo any deal for mere disadvantage; emancipated minors only for deals beyond their authority.
Notes: Rescission for minors: unemancipated = any lesion; emancipated = excess of capacity. Cf. Code Napoléon Art. 1305.
