Il faut nécessairement exister à l'instant de l'ouverture de la succession pour y succéder. Ainsi en sont incapables, 1°. Ceux qui ne sont pas encore conçus; 2°. L'enfant qui naît vivant, mais qui ne peut vivre.

Life lesson: You must exist to inherit — not yet conceived, or born alive but unable to survive, and you are excluded. Existence is the first requirement of succession.
Notes: Capacity to inherit: must exist at opening. Two incapacities: (1) not yet conceived; (2) born alive but non-viable. Existence requirement. Cf. Code Napoléon Art. 725.
