Des Servitudes qui dérivent de la Situation des lieux

Property Law
Titre XIV: Des Servitudes ou Services fonciers (On Servitudes or Land Services)
Chapitre I: Des Servitudes qui dérivent de la Situation des lieux (On Servitudes Deriving from the Situation of Places)

Lorsque le propriétaire veut se clore, il perd son droit au parcours et vaine pâture, proportionnellement au terrain qu'il y soustrait.

Life lesson: Enclose your land, and you forfeit the right to graze on the commons — in proportion to what you withdrew. The fence that keeps others out also locks you in.
Notes: Enclosure and loss of commons: enclosing owner loses parcours/vaine pâture rights proportionally. Trade-off: private enclosure vs. communal grazing rights. Important in Haitian agrarian context. Cf. Code Napoléon Art. 648.
