Dès le moment que l'usufruit commence, les fruits en provenans sont dus à l'usufruitier; et ce droit ne peut lui être enlevé par le retard qu'il pourrait apporter à fournir caution.
Life lesson:
The fruits are owed from day one — delay in posting security does not forfeit the right. The usufruct begins when it begins, not when the paperwork is done.
Notes:
Commencement of fruit entitlement: runs from opening of usufruct, not from furnishing of security. Delay in posting caution does not prejudice fruit rights. Cf. Code Napoléon Art. 604.
