RESOLUTION of the Conseil du Cap, on the occasion of a corvée of nègres ordered for the fortifications, by virtue of an unregistered article of a King’s Memorandum
UPON what had been observed to the Court, that since the 6th of the current month, an order had been sent to the Settlers that they were to furnish, by Monday the 13th, nègres for the fortifications of the Cap; and after deliberation upon it, the Court resolved that it shall be represented to Messrs. the General and Intendant that the Regulation of the two Conseils of 16 March 1751, confirmed by the King’s Memorandum of 22 July of the same year, had expressly stipulated exemption from all corvées of nègres; that the King’s Memorandum of 7 November 1754, in confirming them, seems indeed to make distinctions, and to admit extraordinary corvées of nègres; but that this article not having been registered in the Court, and the fundamental Law of the State being that no Edict or Declaration has effect before registration, THE CONSEIL was of the opinion that no corvée of nègres should have been ordered until it should please the King to explain himself on the very humble remonstrances that it has been resolved to make to him.
