DECREE of the Conseil du Cap confirming a Sentence of the Siége-Royal of the same City, which declares inadmissible a demand for relinquishment against a Third-party holder

Haitian

BETWEEN Sieur Raby du Moreau, Chevalier de Saint-Louis, Assignee of the Heirs of Claude Bidon, universal legatee of Antoine Bidon (provider of the funds), Appellant; And the man named Carrere, free quarteron (Third-party holder of two houses and lots located at the Cap); And the Dame widow of Sieur Carrere (original Purchaser from the late Sieur Bidon). On the report of M. le Gris.

The Conseil du Cap held, as the first Juge had, that the Declaration of the King of 12 January 1734, which speaks only of the relinquishment by Purchasers, could not be extended to Third-party holders.
