DECREE of the Conseil d’Etat, which quashes that of the Conseil du Cap, of 28 January 1768, on emancipations
THE KING having had laid before him the Decree rendered on 28 January last by the Conseil Supérieur of the Cap, Island of Saint-Domingue, concerning the emancipation of the enslaved, which Decree orders the execution of the Ordinance of His Majesty of 15 June 1736, and contains some provisions that were not included in the said Ordinance, His Majesty has recognized that this Decree is contrary to Art. XXXIX and XXXXI of the Ordinance of 1 February 1766, concerning the Government of the Leeward Islands, both in that what concerns emancipations belongs exclusively, to the exclusion of all others, to the Gouverneurs and Intendants of the said islands, and in that His Majesty having ruled on this subject by his Ordinance of 15 June 1736, he alone could bring changes or modifications to it.
Registered at the Conseil du Cap, 25 May 1771.
ORDINANCE of the King, on the form of the emancipations of the Enslaved. Of 10 July 1768. BY ORDER OF THE KING.
