Des décrets ou mandats

Criminal Procedure
Titre II: De la procédure criminelle (On Criminal Procedure)
Chapitre V: Des décrets ou mandats (On Decrees or Warrants)

Le juge d'instruction, après avoir interrogé l'accusé et ouï le procureur du roi en ses conclusions par écrit, pourra, si le fait donne lieu à une peine afflictive, décerner contre l'accusé un mandat d'arrêt ou décret de prise de corps.

Life lesson: For crimes serious enough to warrant physical punishment, the judge can issue an arrest warrant — but only after interrogating the accused and getting the prosecutor's written opinion.
Notes: Mandat d'arrêt / prise de corps threshold: peine afflictive offenses. Prerequisites: interrogation of accused + written prosecutorial conclusions. Maximum-coercion warrant. Three-step process: interrogate → prosecutorial conclusions → warrant. Afflictive penalty = imprisonment, corporal punishment, death.
