De l'interrogatoire des prévenus

Criminal Procedure
Titre II: De la procédure criminelle (On Criminal Procedure)
Chapitre IV: De l'interrogatoire des prévenus (On the Interrogation of the Accused)

Toute la procédure faite jusqu'au moment où l'accusé voudra répondre, subsistera, même la confrontation ; et il ne pourra fournir de reproches contre les témoins, s'ils ne sont justifiés par écrit.

Life lesson: If a silent accused finally decides to talk, everything done during their silence still stands — including witness confrontations — and they can only challenge witnesses with written proof.
Notes: Validity of proceedings during silence: all acts subsistent including confrontation. Resumption of participation: allowed but prior proceedings not invalidated. Reproches contre témoins: only if justifiés par écrit. Written evidence requirement for belated witness challenges. Penalizes strategic silence without permanently barring participation.
