Si elle est reconnue marchande publique, elle pourra contracter sans l'autorisation de son mari, qui, dans ce cas, est et devient solidaire pour ses faits de commerce.
Life lesson:
Once recognized as a merchant, a woman can deal freely — but her husband becomes jointly liable for her commercial obligations.
Notes:
Authorized marchande publique: full contracting capacity without further marital authorization. Husband becomes solidarily liable. Trade-off for commercial freedom.
