Chapitre IV: De l'Extinction des Obligations (On the Extinction of Obligations)

La compensation s'opère à l'insu des débiteurs; sa force venant de la loi, elle se fait de plein droit; ainsi les deux dettes sont réciproquement éteintes au moment où elles ont existé ensemble, jusqu'à concurrence seulement de leurs quotités respectives.

Life lesson: Set-off is automatic — the moment two debts coexist, they cancel to the extent of the smaller. No one needs to ask.
Notes: Automatic set-off: operates ipso jure, without knowledge, at moment of coexistence, to the extent of the lesser amount. Cf. Code Napoléon Art. 1290.
