Chapitre I: Des Conditions essentielles pour la validité des Conventions (On the Essential Conditions for the Validity of Conventions)

La convention contractée par erreur, violence, fraude ou mauvaise foi, n'est point nulle de plein droit; elle donne seulement lieu à une action en nullité ou en rescision, dans le cas et de la manière expliqués à la Section VII, du Chapitre IV du présent Titre.

Life lesson: Vitiated consent does not automatically void the contract — it gives the victim an action for nullity or rescission. The contract stands until challenged.
Notes: Relative nullity: consent vices → not void ipso jure, only voidable by action. Must be judicially challenged. Cf. Code Napoléon Art. 1117.
