La demande en partage peut être formée quand l'un des cohéritiers aurait joui séparément de partie des biens de la succession.

Life lesson: Separate enjoyment by one co-heir does not bar the others from demanding partition.
Notes: Partition not barred by separate enjoyment: co-heir's independent use of part of estate does not preclude partition action. Cf. Code Napoléon Art. 816.
