Un titre qui reconnaît la servitude, émanant du propriétaire du fonds asservi, peut seul suppléer un titre constitutif de la servitude.

Life lesson: Only a recognition from the servient owner can replace the missing constitutive title. Acknowledgment from the burdened party is the next best thing to the original grant.
Notes: Recognitive title: only a title from the servient property's owner can substitute for a lost constitutive title. Proof of servitude in absence of original instrument. Cf. Code Napoléon Art. 695.
