Les servitudes actives et passives ne peuvent cesser à l'égard d'un nouveau mur mitoyen ou d'une maison qu'on reconstruirait; mais elles ne peuvent être néanmoins aggravées lors de la reconstruction.

Life lesson: Rebuild the wall or the house — the servitudes survive but cannot grow heavier. Reconstruction preserves obligations without worsening them.
Notes: Servitude continuity: active/passive servitudes survive reconstruction of party wall or house. Cannot be aggravated by reconstruction. Balance between continuity and non-aggravation. Cf. Code Napoléon Art. 665.
