De l'Usage et de l'Habitation

Property Law

Life lesson: Use and habitation are personal rights — they cannot be sold, given away, or rented out. They belong to the person, not to the marketplace.
Notes: Inalienability: use and habitation rights are strictly personal (intuitu personae). Cannot be ceded, transferred, or leased. Distinguishes from usufruct, which can be transferred (Art. 309). Cf. Code Napoléon Art. 634.
