Cependant l'abus que l'usufruitier fait de sa jouissance, soit en commettant des dégradations sur le fonds, soit en le laissant dépérir faute d'entretien, est aussi un motif suffisant pour entraîner l'extinction de l'usufruit. Les créanciers de l'usufruitier ont le droit d'intervenir dans toutes contestations relatives au maintien de leurs droits, et la faculté leur est accordée d'offrir la réparation des dégradations commises et des garanties pour l'avenir. Les juges, suivant la gravité du cas, peuvent prononcer l'extinction absolue de l'usufruit, ou n'autoriser la rentrée du propriétaire dans la jouissance de l'objet qui en est grevé, qu'à condition de payer annuellement à l'usufruitier ou à ses ayans cause, une somme fixée, jusqu'à l'instant où l'usufruit aurait dû cesser.
However, abuse by the usufructuary of his enjoyment, whether by committing degradations on the property or by letting it fall into disrepair for want of maintenance, is also a sufficient ground for extinguishing the usufruct. The usufructuary's creditors have the right to intervene in all disputes concerning the maintenance of their rights, and they are granted the ability to offer reparation of the committed degradations and guarantees for the future. The judges, according to the gravity of the case, may pronounce absolute extinction of the usufruct, or authorize the owner's re-entry into enjoyment of the encumbered property only on condition of paying annually to the usufructuary or his assigns a fixed sum, until the time when the usufruct would have ended.
