En cas de provocation de partage, de la part du tuteur, il a besoin de la même autorisation ; mais cette obligation cesse pour lui du moment qu'il s'agit d'une action en partage intentée contre le mineur.
Life lesson:
To divide the estate, the guardian needs permission. But when someone else forces the division, the guardian may defend without asking first.
Notes:
Authorization required to initiate partition but not to defend against it. Practical distinction: defensive litigation cannot wait for council approval. Offensive litigation requires deliberation.
