Lorsque par son fait, le créancier ne peut plus subroger la caution dans tous ses droits, le cautionnement est éteint.

Life lesson: If the creditor's own actions make it impossible to pass on their rights to the surety, the guarantee dies.
Notes: Extinction by impaired subrogation: creditor's fault preventing surety's subrogation → suretyship extinguished. Protects surety's recourse rights.
