Chapitre IV: Des Obligations du Vendeur (On the Obligations of the Seller)

Que la chose vendue ait diminué de valeur lors de l'éviction, ou qu'elle se trouve considérablement détériorée, soit par des accidens de force majeure, soit par la négligence de l'acquéreur, le vendeur est toujours tenu de restituer la totalité du prix. Mais si les dégradations faites ont tourné au profit de l'acquéreur, le prix ne lui sera restitué que sous la déduction d'une somme égale au profit.

Life lesson: Even if the thing lost value or was damaged — even through the buyer's own neglect — the seller must still refund the full price upon eviction. But any profit the buyer gained from the damage is deducted.
Notes: Seller refunds full price upon eviction regardless of deterioration cause. Exception: buyer's profit from degradation is deducted.
